As of January 1, 2025, a new law prohibiting drivers from using a mobile electronic device while driving went into effect in Colorado. While texting and driving has been prohibited for years, Senate Bill 24-065 bans holding or manually using a phone or other mobile device for any reason, including voice calls. This will require all drivers to use hands-free systems and/or accessories.
According to the Colorado Department of Transportation’s 2024 Driver Behavior Report, 77% of Colorado drivers admitted to using their phones while driving, and 45% said a hands-free feature in their car would stop them from using their phone.
To cite an individual for a violation of the act, a law enforcement officer must see the individual use a mobile device in a manner that caused the individual to drive in a careless and imprudent manner. For a first-time offense, the penalty is $75 and two license suspension points; for a second offense within 24 months, the penalty is $150 and three license suspension points; and for a third or subsequent offense within 24 months, the penalty is $250 and four license suspension points.
The following uses of mobile electronic devices are exempt:
- By an individual contacting a public safety entity;
- By an individual during an emergency;
- By an employee or contractor of a utility when responding to a utility emergency;
- By an employee or contractor of a city or county acting within the scope of the employee’s or contractor’s duties as a code enforcement officer or animal protection officer;
- By a first responder;
- By an individual lawfully parked
