However, the state also has a “Driving While Ability Impaired” (DWAI) law, which applies if a driver’s BAC is between 0.05% and 0.08%. In addition to alcohol-related offenses, Colorado law also addresses impaired driving due to drugs. A driver can be arrested for DUI if their blood tests show 5 nanograms of delta-9-tetrahydrocannabinol (THC), the active ingredient in marijuana, per milliliter of blood or more.

The Colorado Department of Transportation (CDOT) reported that during March 2024 through May 2024, there were 50 impaired driving related deaths in Colorado. In an effort to combat these deaths and other detrimental injuries, CDOT is partnering with the Colorado State Patrol and local law enforcement agencies from April 3, 2025 to April 23, 2025 as part of “The Heat is on Spring Events DUI enforcement period.” During these 21 days, there will be additional law enforcement officers on duty across the state and sobriety checkpoints on various roadways.
